Terms of Service

Welcome to iHeartWheels (“iHW”, “we”, “us”). These Terms of Service (“Terms”) govern your access to and use of the iHeartWheels website, mobile experience, and all related services (the “Service”). By creating an account, listing an item, buying an item, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What iHeartWheels is

iHeartWheels is a peer-to-peer marketplace where individual sellers and dealers post parts and equipment for sale to individual buyers across marine, auto, moto, heavy equipment, aviation, and adjacent categories. iHW is not the seller of any listed item unless clearly stated. We provide the platform, escrow, shipping infrastructure, and dispute assistance; the transaction is between the buyer and the seller.

2. Eligibility

To use iHeartWheels you must be at least 18 years old (or the age of legal majority in your jurisdiction) and capable of forming a binding contract. You must provide accurate, current, and complete registration information and keep it updated. You must not be located in, or a resident of, a country subject to a comprehensive U.S. embargo, and you must not be on any U.S. or applicable sanctions list.

3. Accounts

You are responsible for all activity that occurs under your account. Keep your password confidential. We may suspend or terminate accounts that violate these Terms, engage in fraud, or create risk to the community — with or without notice.

4. Escrow, fees, and payouts

  • Escrow. When a buyer pays for a listing, iHW receives and holds the funds as escrow. Funds are released to the seller after the buyer confirms delivery (or after the 7-day claim window closes for shipped orders).
  • Platform fee. iHW charges the seller a 10% platform fee on the item + shipping subtotal. Buyers pay the listed price plus shipping and applicable taxes.
  • Payouts. Sellers receive payouts through Stripe. Weekly payouts run every Monday to the connected bank account.
  • Refunds. Buyers may file a claim within 7 days of confirmed delivery. If a refund is issued, the platform fee may be returned or retained at iHW’s discretion based on the nature of the dispute.

5. Shipping

iHW may purchase shipping labels on the seller’s behalf via our shipping partner (Shippo). Sellers must ship within 3 business days of payment or provide a written update. Buyers must accept a package in a reasonable condition; refusing delivery without cause forfeits certain claim rights.

Local pickups are supported and require the dual-OTP handoff flow inside the app. Cash-in-hand and off-platform payments are not covered by iHW escrow or dispute assistance.

6. Prohibited items

The following are strictly prohibited on iHeartWheels. Listings that violate this section will be removed and may result in account termination and reporting to authorities:

  • Stolen property or items with tampered / removed VIN, serial number, or ID marks.
  • Airbags, air-bag components, or vehicle SRS parts (federal restrictions apply).
  • Any part designed to defeat emissions systems, including catalytic-converter delete pipes, EGR/DPF deletes, defeat devices, or tuning products marketed to bypass emissions controls.
  • Firearms, ammunition, explosives, fireworks, gunpowder, or components thereof.
  • Hazardous materials that cannot be lawfully shipped by ground carriers, including live batteries with visible damage, leaking fuel tanks, mercury switches, and asbestos-containing brake parts.
  • Counterfeit, replica, or trademark-infringing parts. All branded items must be authentic and accurately described.
  • Recalled parts that have been the subject of an active NHTSA or manufacturer safety recall, unless clearly disclosed and permitted for the specific use.
  • Human remains, animal parts, drugs, alcohol, tobacco, vape, or CBD/THC products.
  • Salvage or flood-damaged parts not clearly disclosed as such in the listing title and description.
  • Any part whose sale, transfer, or shipment is unlawful in the buyer’s or seller’s jurisdiction.

Sellers are solely responsible for ensuring their listings comply with all federal, state, and local laws, including but not limited to emissions, DOT, FAA, USCG, EPA, and hazmat regulations.

7. Listing standards

  • Listings must accurately describe the item’s condition, including any damage, missing components, or reason for sale.
  • Photos must be of the actual item being sold — no stock photos as the primary image.
  • The condition grade (A+ / A / B / C / D / F) must be chosen honestly. Grade mismatch is a common cause of successful buyer claims.
  • All prices are in U.S. dollars unless otherwise stated.
  • Duplicate listings and category stuffing are prohibited.

8. Buyer conduct

  • Do not use iHW to solicit off-platform transactions. Payment must go through iHW escrow.
  • Confirm delivery honestly. False non-delivery claims will result in account termination.
  • Meet in public, well-lit places for local pickups when possible; use the dual-OTP handoff.

9. Seller conduct

  • Do not misrepresent items, condition, or history.
  • Ship within 3 business days of payment unless otherwise agreed with the buyer.
  • Cooperate with claim and dispute processes. Non-response within 48 hours of a dispute filing forfeits your position.

10. Disputes and claims

Buyers may open a claim within 7 days of confirmed delivery for a shipped order. Claims may be resolved by refund (full or partial), replacement, or seller credit at iHW’s reasonable discretion. Sellers must respond to claim inquiries within 48 hours. iHW may use any evidence provided by the parties, including photos, videos, tracking, and chat history, to reach a decision.

11. Intellectual property

iHW, the iHeartWheels name, and the associated logos are trademarks of the operating entity. All content you post — photos, descriptions, videos — remains yours, but you grant iHW a worldwide, royalty-free, non-exclusive license to host, display, promote, and use that content for operating and marketing the Service.

12. DMCA / IP infringement

If you believe content on iHW infringes your intellectual property rights, email support@iheartwheels.com with (a) identification of the copyrighted work, (b) URL of the allegedly infringing listing, (c) your contact information, (d) a good-faith statement, and (e) a signature. We respond to complete notices within a reasonable time.

13. Warranties and limitation of liability

The Service is provided “as is”, without warranties of any kind, express or implied. To the maximum extent permitted by law, iHW is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability for any claim arising out of your use of the Service is limited to the greater of (a) the total fees you paid to iHW in the 6 months preceding the claim, or (b) US$100.

14. Indemnification

You will indemnify and hold iHW, its officers, employees, and partners harmless from any claim arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of third-party rights, or (d) the sale, purchase, or shipment of any item through iHW.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute must be resolved in the state or federal courts located in Delaware, unless resolved through binding arbitration on an individual (non-class) basis. You waive any right to a jury trial and to participate in a class action.

16. Changes to the Terms

We may update these Terms from time to time. Material changes will be posted in-app or emailed to your registered address. Continued use of the Service after the effective date constitutes acceptance.
